Village of Bay City

GENERAL MEETING, May 10, 2023

PRESENT: Roger Spindler, Norman Baker, Terry Johnson, Jerry McConnell, Kimberly Lunda, Chris Zenner, Jon Ebensperger was unable to attend the meeting.

CALL BOARD MEETING TO ORDER

MOTION: to Accept April 12, 2023, Board Meeting Minutes by Johnson/Baker, motion carried.

DISCUSSION on some of the issues we have been having with trains in the Village with Lydia Underdahl with BNSF Railway on hand for the meeting and discussion. It was a positive discussing with the board able to ask questions. The board agreed that we would continue to work together to make a peaceful relationship and Lydia discussed that BNSF wants to have good relationships with the public sector. Lydia explained to the board that they do not have jurisdiction over the railroad. She said that BNSF will be working on not having trains set for long periods of time outside the daycare in town and not right outside of the Village office. A citation was issued to BNSF from the village, having the trains setting here in town idling is a violation of our noise and pollution ordinance. The Village Board agreed that we will drop the citation and BNSF thanked us for that and agreed to try to solve the issues we were having.

DISCUSSION on our Villages Disaster declaration the Pierce County Emergency Management being on hand to go over what is required for the State of Wisconsin to apply for State Disaster Funding. We will be working on this over the next month as the deadline is the first week of June.

PUBLIC WORKS: Chris reported that the campground bathrooms are up and running we are still working on the campground and getting debrie removed. Chris reported that yearly calibrations for the Gas Monitor were coming up in another week. The discussing turned to the repair of the blower at the ponds and the fact that we do not have a oxygen sensor on the blower unit which would tell the blower unit when to run. The board decided that in order to save the fan from needing further repair the oxygen sensor needs to be purchased. The pipefitters were here in town to weld the pipe together that will be used for the dredging that will start this spring. They welded 2000-foot sections together and they are currently floating on Lake Pepin.

DISCUSSION on preparations for the Groundbreaking Ceremony, the board just briefly rundown what preparation had been completed and we discussed the putting up of the tent for refreshments and what was needed for that.

MOTION to purchase and install a oxygen sensor for the blowers at the ponds by Baker/Johnson, motion carried.

MOTION to approve the Consumer Confidence Report for 2022 by Johnson/Baker, motion carried.

MOTION to approve purchasing emergency contact boxes for the campground by Baker/Johnson, motion carried.

MOTION to go into closed session, roll call vote per Wis Stat 19.85(1)(g)

MOTION to go into closed session per Wis. Stat 19.85(1)(g) to confer with Legal Counsel (either by phone or in person) who is rendering oral or written advise concerning strategy to be adopted by the board with respect to litigation in which it is involved with David Meixner. Wis.Stat 19.85(1)(f). To consider legal issue on the campground area.
