GENERAL MEETING, December 11, 2019

CALL BOARD MEETING TO ORDER.

MOTION to accept November 13, 2019 Board Meeting Minutes by Jon Ebensperger and Davis Niebeling, motion carried.

The Board took any questions regarding the ATV trail, the board explained to the ATV club that the trail approval would be on a one-year probationary period and could be revoked at any time if the board felt that this needed to happen. The opening of the trail was also conditional basis pending Pierce County approving the use of County Road EE.

MOTION to Approve having the ATV trail starting at County Road EE to W6454 Cemetery Road on to the Property of Alice and Mike Celt going down the hill onto the public Parking area at Mikes Baytown by Johnson/Baker, motion carried.

MOTION to Approve revised ATV Ordinance No. 71 by Baker/Ebensperger, motion carried.

PUBLIC WORKS Chris Zenner reported that Energenics replace our filters at the lift station that must be replaced once a year. They were past due being replaced and this had caused the sensors to go off at the lift station causing the outside alarms to go off. Chris reported that cross connections were completed. A deer stand was found out by the sewage ponds on the Villages Property, DNR had contacted Chris about it as deer stands have to be removed daily if they are on public property. The board told Chris to take down the stand. A discussion was held about hunting on Village Property and the board has always allowed hunting on Village land and did not want to change that, but they want to ensure that all DNR regulations are being followed by those doing so.

DISCUSSION with Mike House on concerns he has over the excess water run off on his property since Bruce Andrews put the storage sheds up. Mike asked the board if there was anything they would do about the problem and they advised them that all state requirements were met by Bruce Andrews and that at this point there was nothing that they could do. Bruce Andrews was on hand and he discussed the state requirements with the board and assured the board and Mike that he would try to work with him and try to get the water drainage issue taken care of to Mr. House’s satisfaction.

MOTION to Approve putting additional coping and a snow bar on Village Hall Roof by Johnson/Baker, motion carried.

MOTION to approve putting Beverly Bach on ALL bank accounts by Ebensperger/Niebeling, motion carried.

MOTION to Approve the Cemetery Caretaker contract to Hubert Schladweiler from Hager City by Johnson/Baker, motion carried .

MOTION to Approve the Village Garbage contract to Paul’s Industrial Garage by Johnson/Baker, motion carried.

MOTION to Approve the revision of the Boat Launch Ordinance No. 2019-1 along with the wording on the sign by Johnson/Ebensperger, motion carried.

MOTION to set the Caucus date for January 8, 2020 by Ebensperger/Baker, motion carried.

MOTION to go into Closed Session-roll call vote per Wis. State 19.85 (1)(g) to confer with legal counsel (either by phone or in person) who is rendering oral or written advise concerning strategy to be adopted by the board with respect to litigation in which it is involved with David Meixner.

MOTION to return from closed session – roll call vote

ACTION from closed session:

MOTION to retain an expert witness for testimonial services in the matter of The Village of Bay City v. David Meixner, now pending in Pierce County, Wisconsin as matter 18-CV-003 by Johnson/Baker, motion carried.

MOTION to Approve bills by Ebensperger/Niebeling, motion carried.
